लेखक की मान्यता है कि जब तक जिला; राज्य एवं देश स्तर के तीनों न्यायालयों को स्वतंत्र नहीं किया जाता है; तब तक आम जनता न्याय पाने से वंचित रह जाती है; क्योंकि जिला स्तर पर जो दंडनीय घोषित किया जाता है; वह राज्य स्तर के उच्च न्यायालय में अपील करता है; जहाँ सारी प्रक्रिया पुनः आरंभ होती है और न्याय में विलंब होता है। वहाँ भी यदि वह दंडनीय घोषित हो जाता है तो अपने बचाव के लिए उच्चतम न्यायालय में चला जाता है। फिर वहाँ न्याय में विलंब होता है। इस विलंब के कारण अपराध के साक्ष्य मिट जाते हैं; और इतिहास मात्र बच जाता है। हो सकता है कि तब तक अपराधी या अपराध के कारण प्रभावित व्यक्ति की मृत्यु भी हो जाए और न्याय व्यर्थ हो जाए। न्याय में विलंब के कारण होनेवाली क्षति के अनेक उदाहरणों को प्रस्तुत कर लेखक ने इस सिद्धांत को स्थापित किया है कि जिला स्तर के न्यायालय को स्वतंत्रता मिले और उसका निर्णय अंतिम हो; जिससे प्रभावित व्यक्ति को त्वरित न्याय मिल सके। त्वरित न्याय से अपराध की प्रवृत्ति में अवश्य कमी आएगी।
