प्रावधान है कि बिना सरकार की अनुमति के नेताओं और सरकारी अफसरों पर अभियोग चलाया जा सके। अगर यह विधेयक पास हो जाता है तो लोकपाल तीसरी ऐसी संस्था होगी, जो सरकार के बिना किसी हस्तक्षेप के काम करेगी, जिस तरह चुनाव आयोग और न्यायपालिका स्वतंत्र रूप से अपना काम करती हैं।
सरकारी लोकपाल विधेयक के अनुसार दोषी को छह से सात महीने की सजा हो सकती है और घोटाले के धन को वापस लेने का कोई प्रावधान नहीं है। लेकिन जन-लोकपाल विधेयक में उक्त अपराध के लिए कम-से-कम पाँच साल और अधिकतम उम्रकैद की सजा हो सकती है। साथ ही घोटाले की राशि की भरपाई का भी प्रावधान है।
